TERMS AND CONDITIONS OF SERVICE

These Conditions of Sale regulate the offer and sale to consumers of products through the Isotta Gioielli online store owned by the sole proprietorship Irena Coso, and are formulated and provided in compliance with the provisions of Legislative Decree no. 2016 of 6 September 2005 (so-called “Consumer Code”) and any other law applicable to electronic commerce.

You may request additional information through our support services by contacting Customer Service. Furthermore, for any other legal information in reference to the use of the site and purchases made through the site, you can consult the sections: Terms of Use, Privacy Policy, Cookies, Shipping and Deliveries, Payments, Right of Withdrawal, Legal Guarantee of Conformity, Return of Used Product of Equivalent Type, which we invite you to consult periodically as these Conditions of Sale to check for any updates or changes.

1. PARTIES TO THE CONTRACT – COMMERCIAL POLICY

The parties to the contract are:

– Isotta Gioielli, with registered office in Via Mura del Fossato 54, 47826 Verucchio, Rimini, Italy, tax code CSORNI61T62Z149O, VAT number 04553550403 and registration number in the Company Register of Romagna – Forlì – Cesena and Rimini RI/PRA/2021/14745/800, (“Isotta Gioielli”);

– The “Customer” or “Consumer”: the final consumer, or any natural person who makes purchases through the Site for purposes other than his or her own commercial, entrepreneurial or professional activity;

Isotta Gioielli offers its products for sale on the Site and carries out e-commerce activities exclusively towards its end users who are “final consumers” as defined above. In consideration of this commercial policy, we therefore reserve the right not to follow up on orders from persons other than the Consumer. If you are not a Consumer, we therefore invite you to refrain from concluding commercial transactions on the Site.

These Conditions of Sale do not regulate the provision of services or the sale of products by parties other than Isotta Jewels that may be present on the Site via links, banners or other hypertext links. We recommend that you check their conditions of sale before placing orders and purchasing products and services from parties other than Isotta Jewels, because Isotta Gioielli is not responsible for the provision of services by such parties or for the conclusion of e-commerce transactions between users of the Site and third parties.

2. APPLICATION AND MODIFICATIONS OF THE CONDITIONS OF SALE

Before making purchases through the Site, the Customer declares to have read and understood these Conditions of Sale as well as all the indications provided during the purchase procedure and the contents of the following sections: Terms of Use, Privacy Policy and to accept them in full without any reservation.

Isotta Jewels reserves the right to change the contents of these Conditions of Sale and the other documents listed above, by providing evidence of this on the Site. We therefore invite you to periodically consult the Site to verify the presence of any updates or changes. Each change will be effective after publication on the Site.

The Conditions of Sale applicable to a purchase will always be those in force at the time the relevant order is placed.

3. PRODUCT CHARACTERISTICS AND PRICES

Isotta Gioielli offers for sale on the Site exclusively products marked by its own brands.

The essential characteristics of the products are presented on the Site within each product sheet. The images and colours of the products offered for sale on the Site may, however, change and/or not correspond exactly to the real ones due to the Internet browser and monitor used.

The products are offered for sale at the price indicated on the Site at the time the relevant Purchase Order is placed (see below). Product prices may be subject to changes and variations.

We invite you to check the final sale price before submitting the relevant order form, thus confirming the purchase.

The Sales Operation (condition valid for the Italian territory) is carried out without the application of VAT, carried out pursuant to article 1, paragraphs 54 to 89, Law 190 of 2014 as amended by Law 208 of 2015 and Law 145 of 2018 and, unless expressly indicated, does not include any additional costs for shipping and delivery which, where applicable, are in any case made known to the Customer through specific indications on the Site and specifically referred to during the purchase procedure.

4. METHODS OF CONCLUSION OF THE CONTRACT

To purchase one or more products on the Site, the Customer must fill out and transmit electronically the respective order form (hereinafter “Purchase Order”) following the instructions progressively provided during the purchase procedure. All phases of the purchase procedure are clearly described through the pages of the Site and the related texts and graphics.
In the Purchase Order, displayed in its entirety immediately before the conclusion of the contract and in any case before making any payment, summary information is provided regarding the essential characteristics of each product ordered, the price and any shipping costs and/or applicable expenses.

By electronically transmitting the Purchase Order, the Customer unconditionally accepts and undertakes to observe, in the relations with Isotta Gioielli concerning the purchase, these Conditions of Sale. If you do not agree with some of the terms reported in the Conditions of Sale, we therefore invite you not to forward the Purchase Order.

The sales contract is considered concluded and perfected when Isotta Gioielli sends the Customer electronically the confirmation of receipt of the Purchase Order completed and transmitted by the Customer, after verifying the correctness of the data provided and transmitted.

The Purchase Order will be stored in our database for the period of time necessary for processing and in any case not beyond the terms of the law.

Isotta Gioielli reserves the right not to process Purchase Orders that are incomplete or incorrect or not consistent with the commercial policy referred to in paragraph 1 of these Conditions of Sale, as well as in the event of subsequent unavailability of the products ordered. In these cases, we will inform you that the contract has not been concluded and that Isotta Gioielli has not followed up on the Purchase Order, specifying the reasons.

In particular, if the products presented on the Site are no longer available or on sale at the time of your access to the Site, or at the time of sending the order form, Isotta Jewels will promptly inform you of the possible unavailability of the Products. In such cases, the contract will not be finalized and, if already concluded for any reason, it will be automatically considered terminated and no amount will be charged to you.

Any contractual or extra-contractual liability for direct or indirect damages to persons and/or things caused by the failure to accept an order for the reasons stated above is expressly excluded.

5. PAYMENTS

Payment for orders can be made:

(i) with a credit card belonging to the Visa / MasterCard / American Express circuit;

(ii) through the Paypal platform, selecting it during the purchase procedure. You will be redirected to the secure Paypal servers where, by logging in with your credentials, you can complete the payment by charging your credit card, current account or electronic wallet.

In case of payment by credit card, the price for the purchase of the products and any shipping costs will be charged at the time of shipment of the purchased products.

In case of payment with Paypal, the actual charge will take place when the order confirmation email is sent by Isotta Gioielli.

Financial information (for example, the credit/debit card number or its expiration date) will be forwarded, via encrypted protocol, to the banks that provide the related remote electronic payment services, without third parties being able to access them in any way. Furthermore, such information will never be used by Isotta Gioielli except to complete the procedures relating to your purchase and to issue the related refunds in the event of any returns of products, following the exercise of your right of withdrawal, or if it is necessary to prevent or report to the police the commission of fraud through the Site.

Before completing the order, you will have the right to request the issuance of a tax invoice as indicated during the purchase procedure. We inform you that it will not be possible to request the issuance of the invoice once the procedure has been completed and the relative Purchase Order has been sent.

6. LEGAL GUARANTEE OF CONFORMITY

In accordance with the provisions of Title III, Part IV of Legislative Decree 206/2005 (so-called Consumer Code), Isotta Gioielli guarantees that the products purchased on the Site are free from defects. “Defect” means a significant limitation or reduction in the suitability for use of the product in accordance with art. 129 of the Consumer Code. All defects resulting from negligent or improper use of the product are not covered by this warranty.
The defective product, if still covered by warranty, must be sent to the service center together with a copy of the documents suitable to certify the purchase and the delivery date. For any information on this matter, contact Customer Service.

7. PRIVACY

You can obtain information on how we process your personal data by accessing the information on the processing of personal data (Privacy Policy) which we invite you to consult periodically as these Conditions of Sale to verify the presence of any updates or changes.

9. APPLICABLE LAW

The Conditions of Sale are governed by Italian law and in particular by Legislative Decree no. 206 of 6 September 2005 (so-called Consumer Code), with specific reference to the legislation on distance contracts and by Legislative Decree no. 70 of 9 April 2003 on certain aspects concerning trade.

The competent court for the resolution of any dispute will be that provided by the Italian legislation in force at the time of conclusion of the contract.
